Digital Millennium Copyright Act Notice

Legal Awareness respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. ยง 512, we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with applicable law.

We take copyright infringement seriously and are committed to responding promptly to valid claims of copyright infringement. This DMCA Policy outlines the procedures for copyright owners to submit notifications of claimed infringement and for users whose content has been removed to submit counter-notifications.

Filing a DMCA Notice of Copyright Infringement

If you believe that content on Legal Awareness infringes your copyright, you may submit a written notification pursuant to the DMCA. To be effective, your notification must include the following information:

Required Elements of a Valid DMCA Notice

1. Identification of the Copyrighted Work A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works. Provide sufficient detail to enable us to locate and identify the work(s).

2. Identification of the Infringing Material A description of the material that you claim is infringing and that you request be removed or access to which you request be disabled. Include sufficient information to permit us to locate the material, such as the specific URL(s) where the allegedly infringing material appears.

3. Your Contact Information Information reasonably sufficient to permit us to contact you, including your name, address, telephone number, and email address.

4. Statement of Good Faith Belief A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. Statement of Accuracy A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Physical or Electronic Signature A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important Considerations Before Filing

Before submitting a DMCA notice, please consider the following:

Fair Use: Please consider whether the use of copyrighted material may constitute fair use under U.S. copyright law. Fair use is a legal doctrine that permits limited use of copyrighted material without obtaining permission from the copyright owner for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

False Claims: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Please ensure your claim is valid before submitting a DMCA notice.

Complete Information: Incomplete DMCA notices may not be processed. Ensure all required elements are included in your notification.

Our Response to Valid DMCA Notices

Upon receipt of a valid DMCA notice that complies with all legal requirements, Legal Awareness will:

  1. Promptly investigate the claim
  2. Remove or disable access to the allegedly infringing material if appropriate
  3. Notify the user who posted the material that it has been removed or disabled
  4. Take reasonable steps to notify the user of the complaint and their right to file a counter-notification

We reserve the right to remove allegedly infringing content without prior notice to the user who posted it. We also reserve the right to terminate the accounts of users who are repeat infringers.

Filing a DMCA Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with us. A counter-notification is the proper method for challenging a DMCA takedown if you believe the takedown was made in error or that you have the legal right to use the material.

Required Elements of a Valid Counter-Notification

To be effective, your counter-notification must include the following information:

1. Your Physical or Electronic Signature A physical or electronic signature of the user.

2. Identification of Removed Material Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (including the specific URL).

3. Statement Under Penalty of Perjury A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

4. Consent to Jurisdiction A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are located outside the United States, for any judicial district in which Legal Awareness may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

5. Your Contact Information Your name, address, telephone number, and email address.

Our Response to Counter-Notifications

Upon receipt of a valid counter-notification that complies with all legal requirements, we will:

  1. Promptly provide the person who filed the original DMCA notice with a copy of the counter-notification
  2. Inform them that we will restore the removed material or cease disabling access to it in 10-14 business days
  3. Restore the removed material or cease disabling access to it in 10-14 business days following receipt of the counter-notification, unless our Copyright Agent first receives notice from the person who submitted the original DMCA notice that they have filed a court action seeking a court order to restrain the user from engaging in infringing activity relating to the material

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Legal Awareness has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications to DMCA Material

Please note that we may modify, delete, or otherwise edit allegedly infringing material rather than removing it entirely, if we determine that such action is appropriate under the circumstances. This does not affect your rights under the DMCA to file a counter-notification if you believe the modification or editing was done in error.

Misuse of DMCA Procedures

The DMCA provides for significant penalties for submitting false or misleading notices of copyright infringement or counter-notifications. Both copyright owners and users should carefully consider whether a DMCA notice or counter-notification is appropriate before submitting one.

As stated in Section 512(f) of the DMCA: “Any person who knowingly materially misrepresents under this section (1) that material or activity is infringing, or (2) that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.”

Non-Copyright Complaints

This DMCA Policy applies only to claims of copyright infringement. International Users

If you are submitting a DMCA notice or counter-notification from outside the United States, please note that the DMCA is United States law. By submitting a notification or counter-notification, you consent to having any disputes relating to your notification or counter-notification adjudicated in United States courts in accordance with U.S. law.
